1) Scope & Purpose
This policy applies to all tangible products sold on ElOjoArtistico.com (e.g., face creams and other skincare/beauty items), as well as any accessories or bundled kits.
2) Non-Medical Disclaimer
Miguel Ángel Ortiz speaks and teaches about aesthetics but is not a medical doctor or licensed healthcare provider. All information and recommendations on this site are educational and not medical advice, diagnosis, or treatment. You must consult a licensed healthcare professional before using any product, especially if you have existing conditions, are pregnant/nursing, or are under medical treatment. El Ojo Artístico and its representatives are not responsible for any medical decisions you make.
3) Product Use & Allergy Waiver
- Ingredients may vary by batch; always read labels before use.
- Perform a patch test 24–48 hours before first full use.
- Stop using immediately and seek medical attention if irritation or an adverse reaction occurs.
- By purchasing, you acknowledge and agree that El Ojo Artístico, Miguel Ángel Ortiz, and their collaborators are not liable for allergic reactions, sensitivities, adverse effects, or outcomes related to product use, whether used alone or in combination with other products or procedures.
4) All Sales Final — No Returns or Refunds
All product sales are final. We do not accept returns, do not offer refunds, and do not accept exchanges for preference, scent, texture, or skin reaction. This includes opened and unopened items. Shipping fees are non-refundable.
5) Limited Replacement for Damaged or Incorrect Items (If Applicable)
While we do not accept returns or exchanges, we will replace (not refund) an item only if:
- it arrives physically damaged, or
- you received the wrong item.
How to request a replacement:
- Email info@elojoartistico.com within 48 hours of delivery.
- Include your order number, a brief description, and clear photos of: the outer shipping box (with label), inner packaging, and the item damage or wrong item received.
- Keep all packaging until your case is resolved.
Requests submitted after 48 hours, missing photos, or showing signs of use/alteration may be denied. Replacement is subject to product availability; if unavailable, we may issue a store credit at our discretion.
6) Shipping Area & Timing (U.S. Only)
- Shipping only within the United States. We do not ship internationally.
- Estimated delivery window: 7–14 business days from the date the order is processed and shipped (processing typically 1–3 business days).
- Carriers and service levels may vary. Delivery timeframes are estimates and not guaranteed; weather, carrier delays, and high-volume periods can extend timelines.
- Risk of loss passes to you upon carrier’s confirmation of delivery.
7) Addresses, Delivery Issues & Refused Packages
- Please ensure your shipping address is accurate and complete (including apartment/suite). Orders with incorrect or incomplete addresses may be delayed or returned by the carrier.
- We are not responsible for lost/stolen packages after a carrier marks them as Delivered, for delays due to incorrect addresses, or for courier-held/returned parcels.
- Refused or undeliverable packages are not eligible for refunds; additional reship fees may apply if you ask us to resend.
8) Order Changes & Cancellations
Orders are sent to processing quickly and cannot be changed or canceled once placed. Please review items, quantities, and address carefully before checkout.
9) Product Availability & Substitutions
We may limit quantities or decline orders at our discretion (e.g., suspected fraud). If an item is unavailable after you order, we may contact you to offer a comparable replacement or store credit.
10) No Guarantees of Results
Skincare results vary by individual. No specific outcomes are guaranteed. Your results depend on skin type, routine, environment, and other personal factors.
11) Limitation of Liability
To the fullest extent permitted by law, El Ojo Artístico, Miguel Ángel Ortiz, and their collaborators shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from product purchase, possession, or use—including but not limited to allergic reactions, skin irritation, or interactions with other products/procedures. Your exclusive remedy for any claim related to a product is limited to the replacement set out in Section 5.
12) Taxes & Compliance
Applicable sales taxes are calculated at checkout according to U.S. regulations and the shipping destination.
13) Policy Updates
We may update this policy at any time. Changes take effect when posted on this page, with the “Last Updated” date adjusted accordingly. Continued purchases after updates signify acceptance of the revised policy.
